Au jardin des colibris is a seasonal rental residence of the “Ecolodge” type located in a place called Villers 97126 Deshaies – Guadeloupe operated by Sarl Cocoloco.
Any reservation made constitutes acceptance without reservation and in their entirety of the general rental conditions which appear below.
Au jardin des colibris provides accommodation, the precise description of which is indicated on the page of each accommodation on our website www.aujardindescolibris.com. The description on the website will be binding in the event of a dispute.
In addition to the reserved accommodation, Au jardin des colibris provides various services, the details of which are indicated on the “service” page of the website www.aujardindescolibris.com.
Rental is granted for a price which was confirmed when booking. This is payable in full 72 hours before arrival, less the sums paid as a deposit upon booking. It is agreed that the price includes the amount of rent and fixed charges. When booking, a deposit of at least 40% must be paid to confirm the stay on the desired dates.
In addition to the rent, the tenant will pay the lessor a security deposit when handing over the keys to cover any damage that may be caused to furniture and objects. This deposit, which amounts to €450, is payable by credit card.
This pre-authorization will be canceled 15 days after departure, deducting where applicable the remaining charges due, rental repairs, and cleaning costs.
The tenant undertakes to occupy the premises only personally and bourgeoisly as a temporary pleasure residence. This accommodation may under no circumstances be used for living or carrying out a commercial, craft or professional activity.
The tenant undertakes to respect the tranquility of the place and of the other tenants, in addition no parties, noise or music are authorized.
The tenant cannot substitute any person whatsoever, nor sublet the rented premises himself, free of charge or not.
He cannot have the premises occupied by a number of people greater than those indicated at the time of reservation. No visits from people other than those indicated at the time of booking are authorized without express prior agreement from the lessor. In the event of non-compliance with this obligation, a fixed amount of €50 per day and per person present on site without authorization will be required and, if necessary, deducted from the deposit.
Outside animals are not permitted under any circumstances.
The tenant must immediately notify the lessor of any damage occurring or likely to occur and allow access to the premises for the execution of any emergency work that may be necessary.
The tenant is liable for any damage and fully covers the costs of repairs or, where applicable, replacement unless he proves that these damages are not his doing.
The tenant must notify the lessor of his departure and make an appointment for the exit formalities. The accommodation must be vacated on the day of departure no later than 10 a.m. unless expressly agreed by the lessor. The key to the accommodation must be returned to reception upon departure.
The tenant undertakes to return the rented premises in the state of their arrival, or to pay the lump sum of 45 euros for end-of-stay cleaning.
Upon departure, the tenant undertakes to clean and put away their dishes, as well as empty their household waste. In the event of non-compliance with this obligation, a charge of 50 Euros will be taken from the deposit.
The tenant must pay a tourist tax in accordance with local regulations. It amounts to €1 per day and per person over 18 years old. This tax is not included in the rental amount and will be payable on site.
An 8x4m swimming pool, closed by a secure gate, is available exclusively to customers of the hummingbird garden, it is open 24 hours a day. It is forbidden to dive or swim there with flippers. Children under 12 must be accompanied by a responsible adult. The use of the swimming pool is carried out under the full responsibility of each tenant and the hummingbird garden, Sarl Cocoloco, its managers and employees decline all responsibility in the event of an accident and cannot be held responsible under the law. .
For the garden side villa and Jungle lodge which benefit from a private swimming pool:
The use of this private swimming pool is exclusively reserved for tenants of the villa on the Garden or Jungle Lodge side and is carried out under the entire responsibility of the tenant of the accommodation concerned. Le jardin des hummingbirds, Sarl Cocoloco, its managers or employees cannot be held responsible in the event of an accident.
The tenant is not authorized to handle the equipment of this swimming pool (pump, vacuum cleaner and technical room, etc.), he must inform the garden of hummingbirds in the event of the need for technical intervention, maintenance or if the water level pool had fallen below the minimum level determined by the pool skimmer.
The hummingbird nest and the star cabin are unusual accommodations which benefit from a 2x2m suspended net called a “star bed”. The use of this equipment must exclusively be limited to one or two people and a maximum of 200kg, sitting or lying on the net. Under no circumstances should this be used as a “trampoline”, moreover the net is not designed to stand upright. The use of this equipment is carried out under the entire responsibility of the tenant and the jardin des hummingbirds, Sarl Cocoloco, its managers or employees cannot be held responsible in the event of an accident.
Modification = Postponement of a stay with new dates at the time of modification.
The reservation can be modified according to the following calendar and conditions:
* Within 48 hours of validation: No fees.
* More than 60 days before arrival: No fees.
* Between 59 and 45 days of arrival: Fixed modification fee of €50.
* Less than 45 days from arrival: Not modifiable.
The reservation is cancellable and non-refundable under the following conditions:
* Within 48 hours of validation: No fees.
* More than 45 days before arrival: Fixed price of 80€ cancellation fees per stay.
* Between 44 and 30 days before arrival: Flat rate 40% of the amount of the stay cancellation/modification fees.
* Less than 30 days of arrival: Flat rate 100% of the amount of the stay cancellation/modification fees.
A credit note valid for 12 months after deduction of the costs indicated above will be credited to the customer.
The tenant acknowledges that cancellation insurance has been offered to him and that it is his responsibility to choose whether or not to protect himself against this risk.
Reminder: Any reservation at Au jardin des colibris implies acceptance without reservation and in their entirety of these general rental conditions.
