General rental conditions

  1. Preamble

Au jardin des colibris is a seasonal rental residence of the “Ecolodge” type located in a place called Villers 97126 Deshaies – Guadeloupe operated by Sarl Cocoloco.

Any reservation made at the Jardin des Chaibris is unreserved acceptance and in their entirety of the general rental conditions which appear below.

  1. Description of accommodation

In the Jardin des Colibris provided accommodation, the precise description of which is indicated on the page of each accommodation on our website www.aujardindescolibris.com. Only the description present on the website will be proof in the event of a dispute.

  1. Financial conditions

The rental is granted for a confirmed price at the time of booking. A minimum deposit of 40 % is required to validate the reservation. The balance is payable in its entirety no later than 7 days before arrival, deduction made of the deposit paid. The price includes rent, tourist tax and flat -rate charges.

  1. Stay guaranteed by bank card (without automatic flow)

In order to guarantee possible costs related to degradations, non -compliant cleaning or unpaid charges, a valid bank card imprint will be requested no later than 72 hours before arrival. This footprint serves as a warranty for the duration of the stay and replaces the pre -authorization of € 450. Apart from the rental balance, no amount will be automatically debited. However, the customer expressly authorizes the Colibris Garden to take, after his departure, any amount justified in connection with damage noted, an abnormal state of cleanliness or unresolved services.

This procedure is implemented in compliance with the legislation in force and the security standards applicable to the protection of banking data (in particular the GDPR and PCI-DSS standards).

  1. General obligations.

The tenant undertakes to occupy the premises personally, as a temporary leisure residence. In no case can the premises be used for professional, commercial, craft or main housing purposes. The calm of the site and other residents must be respected. Holidays, noise pollution or amplified music are not allowed. It is forbidden to sublet, yield the rental or accommodate a number of people higher than that indicated when booking. Any additional unauthorized person will be subject to a flat -rate invoicing of € 50 per day and per additional person, deducted if necessary from the bank card imprint. Visits to external persons are not authorized, if applicable, they must be expressly validated upstream by the lessor. No outside animal is authorized on the site under no circumstances. Any claim must be reported immediately to the lessor. The tenant must allow access to housing for urgent interventions. The tenant is responsible for the degradations caused and will cover the costs of repairing or replacement, unless he proves that he is not responsible for it. The departure must be reported to the lessor, the accommodation must be released no later than 10 a.m. on the day of departure, unless otherwise agreed. The keys must be returned upon receipt or left on the door of the accommodation. The accommodation must be rendered in a suitable state of cleanliness. The dishes must be cleaned and tidy, the garbage cans emptied. In the event of non-compliance with one of these points, a € 50 package will be deducted from the bank card footprint.

  1. Tourist tax.

A tourist tax of € 1 per day and per adult person will be collected in accordance with local regulations. It is not included in the rental price and will be payable with the rental balance 7 days before arrival.

  1. Common swimming pool terms of use.

An 8 × 4 m swimming pool, closed by a secure gate, is reserved exclusively for customers in the Colibris Garden. Diving, balloons, beach games and the use of palms are prohibited. The shower is mandatory before swimming. The use of the swimming pool is formally not recommended in the event of a thunderstorm. Children under 12 should be accompanied by an adult. The swimming pool is not monitored. Its use is done under user responsibility. Access to the pool is protected by a safety gate in accordance with the regulations in force, intended to limit the risk of accidents, especially in young children. It is up to the tenant to ensure that this gate remains permanently closed and never leave it open without supervision. In the event of dysfunction or defective closure, the tenant undertakes to immediately inform the owner. This system constitutes a prevention measure, but in no way exempts from the constant alertness of adults. SARL Cocoloco, its managers and employees decline any responsibility in the event of an accident.

  1. Private swimming pool “Côté Jardin and Jungle Lodge”.

These swimming pools are exclusively reserved for tenants of these dwellings. Their use is carried out under the full responsibility of the tenant . A pool alarm in accordance with the regulations in force is made available to ensure the safety of the occupants. It is up to the tenant to activate it systematically after each swim and outside the periods of use. In the event of dysfunction noted, the tenant undertakes to immediately inform the owner. The alarm constitutes a prevention system, but in no way replaces the vigilance of adults, especially towards children. The tenant must in no case handle the equipment (pumps, vacuum cleaners, technical room). In the event of a problem, he must notify the staff of the Colibris garden.

  1. “Star bed” for the Hummingbirds’ Nest and the Star Cabin.

The hummingbird nest and the star cabin are unusual accommodations which benefit from a 2x2m suspended net called a “star bed”. The use of this equipment must exclusively be limited to one or two people and a maximum of 200kg, sitting or lying on the net. Under no circumstances should this be used as a “trampoline”, moreover the net is not designed to stand upright. The use of this equipment is carried out under the entire responsibility of the tenant and the jardin des hummingbirds, Sarl Cocoloco, its managers or employees cannot be held responsible in the event of an accident.

  1. Modification and cancellation conditions.

Modification = Postponement of a stay with new dates at the time of modification.

The reservation can be modified according to the following calendar and conditions:

* Within 48 hours of validation: No fees.

* More than 60 days before arrival: No fees.

* Between 59 and 45 days of arrival: Fixed modification fee of €50.

* Less than 45 days from arrival: Not modifiable.

The reservation is cancellable and non-refundable under the following conditions:

* Within 48 hours of validation: No fees.

* More than 45 days before arrival: Fixed price of 80€ cancellation fees per stay.

* Between 44 and 30 days before arrival: Flat rate 40% of the amount of the stay cancellation/modification fees.

* Less than 30 days of arrival: Flat rate 100% of the amount of the stay cancellation/modification fees.

A valid for 12 months deduction of the costs indicated above will be put in the customer's credit, no refund will be made.

The tenant acknowledges that cancellation insurance has been offered to him and that it is his responsibility to choose whether or not to protect himself against this risk.

Personal data

The information collected as part of the reservation is used exclusively for the management of the stay. They are neither sold nor transmitted to third parties. The tenant has the right to access, rectify and delete his personal data in accordance with the regulations in force.

Force majeure

SARL Cocoloco cannot be held responsible for a cancellation imposed by a case of force majeure (cyclone, epidemic, administrative ban, strike, dams, etc.). In these exceptional situations, a credit can be offered. No refund will be made.

Reminder: Any reservation at Au jardin des colibris implies acceptance without reservation and in their entirety of these general rental conditions.
